Tennessee landmark-case research must account for the state's three grand divisions, each with separate appellate records stored in Nashville, Knoxville, and Jackson. Researchers must file separate records requests with the Tennessee State Library and Archives and the three federal district courts.
Records Access and Liability Considerations
Many civil-rights cases from the 1950s and 1960s remain under seal or require redaction of living parties. Applicants must submit a compliance memorandum addressing Tenn. Code Ann. § 10-7-504 and federal privacy rules before any document reproduction. Failure to include this memorandum results in automatic rejection.
Implementation Constraints Specific to Tennessee
The state operates no centralized digital portal for 20th-century appellate briefs; researchers must visit each of the three state supreme court branches. Travel logistics require 14 to 21 days on site because the branches do not share reading-room hours. Budgets must therefore list separate per-diem calculations for Middle, East, and West Tennessee rather than a single statewide figure.
Unlike Kentucky or Alabama applications, Tennessee requires proof that the research team includes at least one member who has completed the state's mandatory records-request training course before any file review begins.
