Tennessee statutes require that any trail proposal crossing more than one county obtain resolutions from each county legislative body before state permits are issued. The average time from initial resolution to final permit is 11 months, during which applicants must maintain public comment records and respond to written objections filed by adjacent property owners. Organizations without prior experience in these procedures report rejection rates above 40 percent on first submission.
Eligibility is restricted to 501(c)(3) entities registered with the Tennessee Secretary of State for at least 24 consecutive months and holding current registration with the state Department of Revenue for sales-tax exemption. Fiscal agents are not permitted; each applicant must demonstrate its own audited financial statements for the preceding two years showing operating reserves of at least 15 percent of the requested grant amount.
Application materials must include a parcel-level map identifying all parcels within 500 feet of the proposed corridor and evidence that each owner received written notice by certified mail. Public forums must be held in each affected county, with minutes and attendance sheets submitted as supporting documentation. Failure to document these steps results in administrative denial regardless of project merit.
Tennessee’s ridge-and-valley topography concentrates population along interstate corridors while leaving plateau counties with limited road access. Applicants must therefore demonstrate that equipment staging areas lie within 1.5 miles of a state-maintained highway with a minimum 10-ton load rating. This requirement eliminates several otherwise viable segments in the Cumberland Plateau.
Unlike Kentucky applications, Tennessee requires each county commission resolution to specify the exact mileage of trail proposed within its boundaries before any state-level review begins.
